Sony’s PlayStation business is facing increasing legal pressure as multiple lawsuits in Europe and the United States challenge whether the PlayStation Store operates as an illegal monopoly for digital game sales.
The lawsuits argue that Sony unfairly restricts competition by requiring digital PlayStation games, downloadable content (DLC), and in-game purchases to be sold exclusively through the PlayStation Store. Because there are no competing digital storefronts on PlayStation consoles, plaintiffs claim consumers have been forced to pay artificially high prices for years.
The largest case is taking place in the United Kingdom, where a class action lawsuit representing roughly 12 million PlayStation users is seeking approximately £1.97 billion ($2.7 billion) in damages. Sony is also defending a major case in the Netherlands, where a consumer organisation representing about 1.7 million players alleges that Sony’s control over digital distribution has resulted in a so-called “Sony tax.” The lawsuit claims digital PlayStation games often cost significantly more than physical editions because consumers have no alternative digital marketplace. If successful, the case could force Sony to open the PlayStation ecosystem to third party digital game retailers and pay more than €400 million in compensation.
In the United States, Sony has already agreed to resolve one consumer antitrust case through a $7.85 million settlement related to allegations that it monopolised digital PlayStation game sales after eliminating third-party retailers’ ability to sell PlayStation digital download codes. That settlement does not resolve the broader antitrust questions now being pursued in Europe.
At the center of every lawsuit is Sony’s business model for digital games. Since 2019, players have generally been required to purchase digital PlayStation titles directly from the PlayStation Store, where Sony controls pricing and reportedly takes a standard commission on sales. Plaintiffs argue this eliminates competitive pricing and results in consumers paying more than they would in an open marketplace.
Sony denies the allegations. The company argues that its pricing reflects the substantial investment required to develop and maintain the PlayStation ecosystem and notes that it still competes with other gaming platforms, including Xbox, Nintendo, and PC gaming, for players and developers.
